It’s Considered Theft
Let’s be honest. Those pallets belong to someone, even if they are sitting outside by the dumpster. Under Texas Penal Code Section 31.03, theft means taking someone else’s property without their permission. Texas punishes theft based on how much the stolen items are worth. Even a small stack of pallets worth under $100 could count as a Class C misdemeanor.
Most businesses will not call the police over a few pallets. But “I probably won’t get caught” is not the same as “this is legal.” Store managers and property owners have every right to call it theft or trespassing if they want to.
The Fix Is Simple: Just Ask

Most businesses are happy to let you take pallets away for free. A big pile of used pallets takes up space, can be a tripping hazard, and often costs the business money to haul off. Ask at the front desk or the loading dock. Most of the time, someone will say “sure, go ahead.” Once you have that permission, there is nothing to worry about.

- Talk to a manager. Someone else on staff may not be allowed to say yes.
- Ask during business hours, not after closing when no one is around.
- Only take pallets that look old or broken, not ones set aside for shipments.
- If you want pallets on a regular basis, ask if you can set up a standing pickup.
When It’s Not Worth the Hassle
Even with permission, hunting for pallets yourself has downsides. The supply is not steady, and the pallets are often beat up. If you need pallets often, for shipping, storage, or a project, it is usually easier and cheaper to work with a supplier that already has pallets sorted and ready to go. If you have a growing pile of pallets and just want it gone, you can skip the guesswork and have it hauled away professionally instead of waiting for someone to stop by.
